Limited warranty - right of complaint

VIKING Yachting RescYouTM Liferafts manufactured by Viking Life-Saving Equipment A/S (“VIKING”)

Always, provided your VIKING Yachting RescYouTM liferaft was not purchased for commercial use, you have – as a consumer – a right of complaint if the liferaft proves to be non-conforming. Your right of complaint will apply for two (2) years from the delivery date.  

In addition, you have an extended right of complaint in respect of the fabric materials used in the liferaft. This right of complaint will apply for twelve (12) years from the manufacturing date of the liferaft.

Your right of complaint is always subject to the liferaft being correctly installed, used, maintained and serviced pursuant to the instructions for use.

Your right of complaint will not apply in the event of any non-conformity or damage arising out of (i) inflating the liferaft during ordinary use; (ii) the tearing apart, decomposition or breaking down of the liferaft; or (iii) any modification, maintenance and/or service performed by a person not authorized by VIKING. Nor will your right of complaint apply in the event of (i) any non-conformity or damage caused by you or a third party, (ii) any non-conformity or damage resulting from heat, ultraviolet light, chemicals or oil products, or (iii) any non-conformity or damage resulting from incorrect maintenance, use or storage.

You must notify VIKING as soon as possible and in any event no later than two (2) months after the discovery of a non-conformity, by contacting VIKING at the address and/or email address specified below. Your notice must include a thorough description (preferably with photos) of the non-conformity as well as documentation of your purchase of the liferaft, in the form of a receipt or invoice evidencing the date of purchase.

At VIKING’s option, you must either transport the liferaft to a service workshop designated by VIKING or place it at VIKING’s disposal for inspection at another location. If the non-conformity is covered by your right of complaint, VIKING will reimburse your transportation costs. However, in the event that the liferaft turns out to be conforming, you must pay VIKING’s costs or a reasonable fee for the inspection.

If VIKING ascertains that the non-conformity is covered by your right of complaint, VIKING will at its own account either rectify the non-conformity or deliver a replacement liferaft. Any non-conforming liferaft that is replaced by VIKING will become VIKING’s property. In the event that the non-conformity cannot be recti­fied, or if the liferaft cannot be replaced, without unreasonable costs for VIKING, you will instead be entitled to a proportionate reduction of the purchase price equivalent to the reduction of the value of the liferaft. If VIKING rectifies or replaces the liferaft or provides a proportionate reduction of the purchase price of the liferaft within a reasonable period of time, you will not be entitled to any damages or other compensation nor will you be entitled to terminate the contract of purchase.

If the non-conformity is only covered by the twelve- (12) year right of complaint in respect of the fabric mate­rials, and VIKING rectifies the non-conformity or delivers a replacement liferaft, a new twelve- (12) year right of complaint period will not apply.

This limited warranty and right of complaint does not restrict or otherwise limit any rights that you may have pursuant to mandatory law.
